Terms & Conditions

Welcome to thankyü. These Terms & Conditions apply to all users, individuals and organisations, who register for a thankyü account or service.

1. thankyü Now, Freedom & Boost (for Individuals)

1.1 About Individual Accounts thankyü provides users with thankyü Club features, digital tipping and casual income tools.

Account types:

·       thankyü Now (Free): Includes thankyü Club (Core), standard savings and affiliate deals, and pay-as-you-go (PAYG) platform fees.

·       thankyü Freedom (in-App upgrade): Unlocks thankyü Club (Enhanced) with additional offers, maintaining PAYG tipping access.

·       thankyü Boost (bolt-on): Converts PAYG to a flat-fee "All You Can Earn" model. Add-on for Now or Freedom accounts.

All users must complete KYC. Payouts are made to a registered card/bank account.

1.2 Receiving Tips and Casual Income

·       Receive tips, rewards, or income via thankyü from people or organisations.

·       Funds are held temporarily before payout.

·       Payouts follow thankyü’s standard schedule.

·       A minimum amount (de-minimis) will apply to all transactions. This amount may change from time to time.  Full details are published on our pricing page.

1.3 Responsibility

·       thankyü is not your employer.

·       Users are responsible for tax reporting and compliance.

1.4 KYC Verification

Before the first payout, users must connect a payout method (card/bank account). This is completed in-app, and will trigger the KYC process. The process includes:

·       ID verification

·       Face and ‘Liveness’ check

·       Card validation

·       AML/fraud and sanctions checking

·       Geo-location and IP tracking

2. thankyü Connect (for Teams)

2.1 About Connect A web-based portal for managing pooled tips across teams.

2.2 Key Features

·       No contracts or commitments.

·       Flexible tip distribution.

·       Each staff member must have a thankyü Now or Freedom account.

·       Direct payouts to individual users.

2.3 Admins & Setup

·       One admin required; additional users optional.

·       Organisations are responsible for compliance.

2.4 Receiving Tips, Gratuities and other Income

·       Customers tip staff directly.

·       thankyü collects and holds tips before payout.

·       A minimum amount (de-minimis) will apply to all transactions. This amount may change from time to time.  Full details are published through our pricing page.

2.5 Employment Status

·       thankyü is not a payroll provider.

·       No PAYE, NIC, or employment tax is applied.

·       Users must declare income; organisations must comply with HMRC tip rules.

2.6 KYB & Verification

During the onboarding process for organisations that wish to use Connect, we will check your organisation details:

·       Registered details,

·       directors,

·       address,

·       bank ownership (via CoP/open banking).

This may include individuals KYC where necessary.

If verification fails or concerns arise, we may decline or suspend accounts.

3. thankyü Thrive (for Organisations)

3.1 About Thrive SaaS platform for donations and community support.

Common users include:

·       Venues, charities, causes, events, community groups, sports clubs.

3.2 Admins & Setup

·       One admin required; multiple users optional.

3.3 Donations

·       Received via public support.

·       Funds are paid to the organisation’s linked account.

·       Organisations manage tax and reporting.

·       A minimum amount (de-minimis) will apply to all transactions. This amount may change from time to time.  Full details are published through our pricing page.

3.4 Employment & Payroll

·       thankyü does not handle wages.

·       Organisations are responsible for compliance.

3.5 KYB & Credit Checks Includes:

During the onboarding process for organisations that wish to use Thrive, we will check your organisation details:

·       Registered details,

·       directors,

·       address,

·       bank ownership (via CoP/open banking).

This may include individuals KYC where necessary.

If verification fails or concerns arise, we may decline or suspend accounts.

4. thankyü Pulse (Feedback Platform)

4.1 About Pulse
thankyü Pulse is a digital feedback tool that enables real-time customer feedback on individual staff members.

4.2 Features

·       Feedback is linked to named users via QR code or digital links.

·       AI-powered dashboards provide trends, sentiment tagging, and performance insights.

·       Admin-only access to protect data visibility.

4.3 Setup

·       Organisations must have a thankyü Pulse account to access Pulse.

·       Staff members receiving feedback must hold an active thankyü Now or Freedom account.

4.4 Guidelines for Use

·       Feedback should be used to support staff development, recognition, and performance tracking.

·       Using Pulse for punitive or disciplinary action is not permitted under thankyü’s ethical use policy.

5. thankyü Club

5.1 Overview Membership offering discounts, cashback, and partner deals.

5.2 Eligibility

·       Active thankyü account (Now/Freedom)

·       16+ years old (some offers 18+).

5.3 Offers

·       Offers may change and are subject to availability.

·       thankyü is not liable for third-party offers.

5.4 Data & Privacy

·       Members receive relevant offers and updates.

·       We do not sell data; see Privacy Policy.

5.5 Membership Changes

·       thankyü can update, suspend, or end Club at any time.

·       Users may opt out of communications via settings.

6. thankyü Fees

6.1 Third (3rd) party banking & acquiring ‘Processing’ Fees

·      All tipping, casual income, and donation transactions on thankyü are subject to 3rd party ‘Processing’ fees set by our acquiring and banking partners. These cover payment infrastructure, interchange costs, cloud security, governance and transaction handling.

·      These fees are applied on thankyü at market rates.  thankyü provides the option (a toggle on/off) for the payer (e.g. customer), to cover these fees at the point of payment.

·      After fees are deducted, the remaining amount, the “tip”, “income” or “donation”, is passed on to the payee (individual or organisation) in full, with no deductions by thankyü.

6.2 thankyü Platform Fees (PAYG)

·      All thankyü accounts operate, as standard, on a Pay-As-You-Go (PAYG) model with a platform fee that supports the ongoing development, delivery, and support of the thankyü platform and Club ecosystem.

6.3 thankyü in-App Subscriptions

·      Users may upgrade their thankyü accounts in-app to access enhanced features, exclusive offers, or reduced fees.

6.4 thankyü licensing, SaaS & additional services

·      Some thankyü services may carry additional fees, including but not limited to licensing, software-as-a-service (SaaS), deployment support, training, branded materials, and advanced data insights.

·      These fees may be quoted directly at the point of purchase or outlined in custom proposals.

7. GDPR & Data Use

·       thankyü processes data under UK GDPR.

·       Data is used for platform operation, communication, and trusted partner offers.

·       We never sell your data. See our Privacy Policy for details.

7.1 Data Insights, Analytics & Fair Use

In addition to our responsibilities under UK GDPR, thankyü processes anonymised data from tipping, feedback, donations, and platform interactions to help improve services for all users.

·       Ownership: Data collected through the thankyü platform (e.g. tipping amounts, feedback responses, usage patterns) remains the property of the respective individual or organisation.

·       Anonymised Use: By using thankyü, you grant us permission to analyse, aggregate, and use non-personally identifiable data to:

o   Provide insight dashboards and reports to users

o   Identify service trends and customer behaviour patterns

o   Benchmark industry performance

o   Improve platform features, tools, and user experience

·       Protection: No customer names, personal details, or direct feedback content will ever be published or shared externally. thankyü never sells user data and only uses it in line with this clause and our Privacy Policy.

This clause applies to all thankyü services, including tipping, Pulse feedback, donations, and Club activity. Data is always handled in a secure and ethical way to support fairness, recognition, and better outcomes for the thankyü community.

8. Account Suspension

Accounts may be suspended or terminated if:

·       Users engage in fraud, data breaches, or illegal conduct.

·       Users may request to close their account at any time.

9. Liability

·       thankyü services are provided "as is".

·       Users are responsible for legal, tax, and financial compliance.

10. Communication Preferences

·       Users can manage email and offer preferences in their account settings.

11. Commercial Agent Exemption (CAE)

By signing up for a thankyü account and using the platform to receive payments, you acknowledge and agree that thankyü is appointed as your limited-purpose commercial agent.

·      thankyü is appointed as your limited-purpose commercial agent solely to receive, hold, and process payments on your behalf.

·      All payments made through thankyü are collected in your name and settled to you via your designated payout method.

·      You retain legal title and beneficial ownership of all funds at all times; thankyü does not act on behalf of payers, donors, or customers.

·      This arrangement qualifies under the Commercial Agent Exemption, as defined under UK and EU payment services legislation.

This appointment remains in effect until you close your account or revoke it in writing. By using thankyü, you confirm that you have read, understood, and accepted these Terms & Conditions.

14. Acceptance

By registering for thankyü and agreeing to our terms and conditions (1) during the onboarding process, (2) in-app or (3) accepting a thankyü proposal, you confirm you have read and agreed to these Terms & Conditions.
